1. Acceptance of Terms
These Website Terms and Conditions govern the travel planning, booking assistance, and related services provided by AHTRAVELSNYC, which is owned and operated by Ayesha Humphrey in New York City.
By using www.ahtravelsnyc.com, requesting travel planning services, submitting an inquiry, or booking travel through me, you agree to these Terms and Conditions. If you do not agree to these terms, please do not use my website or request services from AHTRAVELSNYC.
These terms apply together with any supplier terms, booking conditions, cancellation policies, insurance policy terms, and other documents that apply to your specific travel arrangements.
2. Agency Identity and Required Disclosure
AHTRAVELSNYC is an independently owned travel agency. I am not a tour operator, airline, cruise line, hotel, resort, destination management company, or other travel supplier.
I arrange travel on behalf of third-party travel suppliers. The supplier providing your travel service is responsible for delivering that service under its own terms and conditions.
AHTRAVELSNYC is an Independent Agent of CST No. 2090937-50 and Florida Seller of Travel License No. TI124868.
3. Services
I provide personalized travel planning and booking assistance for leisure travelers, families, couples, and groups. My services may include:
- Personalized vacation planning
- Cruise bookings with suppliers such as Royal Caribbean, Carnival, AMA Waterways, and other cruise lines
- Guided tour packages, including packages offered by providers such as Globus
- All-inclusive resort stays, including destinations and properties offered through providers such as Beaches Resorts
- Disney Resort Collection stays
- Custom travel itineraries for destinations such as Alaska, Greece, Hawaii, Italy, Mexico, New York City, the Caribbean, and other destinations
- Assistance with flights, hotels, transfers, excursions, travel insurance information, and other trip-related arrangements when available
I book travel on behalf of third-party suppliers. Each supplier controls its own schedules, availability, pricing, inclusions, restrictions, payment deadlines, cancellation terms, refund policies, and service delivery.
4. Booking and Payment Terms
Deposits, final payments, payment deadlines, and other payment requirements are established by the applicable travel supplier. You are responsible for making all required payments by the applicable deadlines.
Failure to make a required payment on time may result in automatic cancellation of your reservation by the supplier. A cancelled reservation may be subject to cancellation penalties, loss of deposits, loss of promotional benefits, or other charges.
Payments must be made by a major credit card or debit card through an authorized payment method. I cannot accept cash or checks, money orders, cashier’s checks, or other payment instruments made payable to me personally unless a separate written authorization expressly permits the payment method.
Charges may appear on your credit card or bank statement as "Cruises and Tours Unlimited" or "OutsideAgents.com," or as the specific vendor or merchant.
You are responsible for declined payments, rejected payments, unauthorized payment claims, payment reversals, and chargebacks relating to your booking. A chargeback does not automatically cancel your supplier reservation or release you from payment obligations, cancellation fees, or other amounts owed.
5. Quotes, Pricing, and Availability
Quotes are estimates until a required deposit has been received and the reservation has been confirmed by the applicable supplier. Pricing, availability, taxes, fees, schedules, accommodations, inclusions, and restrictions may change before confirmation.
The applicable supplier controls final pricing and availability. Supplier pricing may change without notice, including because of inventory changes, currency fluctuations, fuel costs, government taxes, resort fees, or other supplier policies.
Promotional offers, discounts, credits, upgrades, onboard benefits, and other special offers are subject to the applicable supplier’s terms and conditions. Promotional offers may be limited, changed, or withdrawn by the supplier without notice.
6. Planning and Service Fees
I provide up to three (3) complimentary trip quotes at no charge. After those three (3) complimentary trip quotes are used, a one-time Twenty-Five Dollar ($25) fee applies, payable in advance before I prepare any additional quotes. Once the one-time fee is paid, I do not charge additional trip quote fees for additional quotes.
For a group booking of 8 or more travelers, a one-time group planning fee of $75 applies to the group as a whole, payable in advance before I begin group planning work. The threshold of 8 or more travelers continues to apply to the group as a whole. This fee is a single fee for the group and is not counted per traveler, per family, per cabin or per room. This fee is separate from and in addition to the trip quote policy.
Any other planning, research, consultation, change, administrative, or service fee will be quoted in writing before the applicable work begins. By authorizing the work after receiving written notice of the fee, you agree to pay that fee.
Planning and service fees are separate from deposits, trip costs, supplier fees, cancellation penalties, travel insurance premiums, and other charges imposed by a travel supplier or third party.
7. Promotions, E-Gift Cards, and Third-Party Booking Links
From time to time I offer a Fifty Dollar ($50) e-gift card as a thank-you to clients. It is issued only to a client who has booked a trip with me and completed that trip. It is not issued at the time of booking.
This offer applies only to trips that I book and plan for you. A trip you book on your own is not a trip booked with me and does not qualify, even when you reach that booking site through a link, button, or recommendation on my website.
Specifically, a booking you make directly with a third-party booking site such as Viator or Golden Tickets does not qualify for the e-gift card, and does not count toward it, because you booked that trip yourself and I did not plan or book it.
The e-gift card has no cash value, is not redeemable for cash, and is not transferable.
I may change or end this offer at any time, and it applies only to qualifying bookings made while it is on offer.
Some links on my website to third-party booking and activity providers, including Viator and Golden Tickets, are affiliate or partner links. I may earn a commission if you book through them. When you book through one of those links, your booking is made directly between you and that provider, on that provider's own terms, conditions, cancellation policy, and pricing, and is not a booking with me. I do not earn or receive the e-gift card on those bookings because I did not make the booking.
Golden Tickets is a resale marketplace for event tickets and is not affiliated with any box office, promoter, venue, theatre, or team, and prices there may be above the face value of the ticket. If you book through that link, you are buying from a resale marketplace on its own terms, not from me, and not from the venue.
Activity and tour bookings made through the Viator link are made with Viator on Viator's own terms. I am not the seller of those tours or activities and I do not control their availability, pricing, or cancellation terms.
8. Cancellations, Changes, and Refunds
The cancellation, change, credit, and refund policies of the applicable travel supplier govern each booking. Many travel arrangements are non-refundable, and penalties may equal 100% of the trip cost after final payment.
I do not charge a cancellation fee of my own. Any cancellation, change, credit, or refund is subject to the applicable travel supplier’s policies and any amounts imposed by the applicable supplier or third party.
You must request all cancellations in writing. A cancellation is not effective until I confirm receipt of the request and the applicable supplier processes the cancellation.
Supplier processing times for refunds, credits, or other adjustments vary. I do not control the timing, form, or amount of any supplier refund or travel credit.
Changes requested after booking may result in supplier fees, fare differences, administrative charges, loss of availability, or cancellation penalties. I will communicate available options when reasonably possible, but I cannot guarantee that a requested change can be made.
9. Travel Insurance
I strongly recommend travel insurance for every trip. Travel insurance may help protect against certain unexpected events, including eligible trip cancellation, interruption, delay, medical expenses, baggage loss, or other covered situations.
To maximize the possibility of coverage for pre-existing medical conditions and certain cancellation benefits, travel insurance should generally be purchased at or near the time of the initial trip deposit. Policy-specific deadlines apply.
Travel insurance is offered through third-party insurers and is not required to book travel through AHTRAVELSNYC. I am not an insurer, insurance underwriter, or claims administrator. Coverage, exclusions, eligibility, deadlines, and claim decisions are controlled by the applicable insurance provider and policy.
You are responsible for reviewing the policy before purchase and contacting the insurer directly with questions about coverage or claims.
10. Travel Documents and Health Requirements
You are responsible for obtaining and maintaining all documents required for your trip. These documents may include:
- A valid passport
- Visas or electronic travel authorizations
- Government-issued identification
- Proof of citizenship or residency
- Vaccination records
- Health certificates
- Parental consent documents
- Other destination-specific documentation
A passport is generally expected to remain valid for at least six months beyond the travel dates, although requirements vary by destination, nationality, itinerary, and supplier.
You are also responsible for meeting all applicable destination entry, vaccination, testing, health, customs, immigration, and transit requirements. Requirements may change at any time.
I provide general travel guidance based on information reasonably available to me. I do not guarantee that the information is complete, current, or applicable to your individual circumstances. You must verify all requirements directly with the relevant government authority, embassy, consulate, airline, cruise line, tour operator, or other applicable authority before departure.
11. Client Responsibilities
You must provide complete and accurate information when requesting a quote or making a booking. This includes:
- Full legal names exactly as shown on travel documents
- Correct dates of birth
- Contact information
- Emergency contact information when requested
- Citizenship and residency information
- Special needs or accessibility requirements
- Dietary restrictions
- Travel preferences
- Any other information reasonably required to arrange or service your trip
You are welcome to review your confirmations and travel documents at any time. As your travel agent, it is my responsibility to double-check your booking details with the applicable travel suppliers directly.
You must report any error to me immediately. Corrections requested after a deposit or booking may result in supplier fees, fare differences, loss of availability, or cancellation penalties.
You are responsible for ensuring that the contact information provided to me and to the applicable supplier remains current and that you monitor relevant communications before and during travel.
12. Independent Contractor and Limitation of Liability
AHTRAVELSNYC is an independent travel agency and independent contractor. I am not an employee, partner, joint venturer, representative, or agent of any airline, cruise line, hotel, resort, tour operator, transportation provider, insurer, or other travel supplier, except to the limited extent necessary to arrange travel on a supplier’s behalf.
I am not liable for the acts, omissions, errors, delays, schedule changes, cancellations, interruptions, overbookings, insolvency, defaults, strikes, weather events, government actions, public health events, lost or damaged baggage, missed connections, personal injuries, illness, death, property damage, or other conduct or failure of any airline, cruise line, hotel, tour operator, transportation provider, insurer, destination provider, or other supplier.
I am also not liable for events beyond my reasonable control, including natural disasters, severe weather, war, terrorism, civil unrest, labor disputes, government restrictions, border closures, epidemics, pandemics, transportation disruptions, or communication system failures.
I will make reasonable efforts to assist with supplier communications when practical. Any assistance does not make me responsible for the supplier’s performance or guarantee a particular outcome.
Nothing in these Terms and Conditions limits or excludes any right, remedy, protection, or liability that cannot legally be limited or excluded under applicable law.
13. Promotions and Gift Cards
From time to time, I may offer promotional rewards to clients. Current promotional offers may include a Fifty Dollar ($50) e-gift card issued to a client after the client has booked and completed their trip with me, traveled, and returned from the trip.
Any e-gift card or other promotional reward is a promotional thank-you only and is not a payment, refund, credit, or price adjustment.
Promotional rewards are issued only if and when the applicable promotional requirements are satisfied. Promotional rewards cannot be exchanged for cash, sold, or transferred.
Any promotional reward is subject to the terms in effect at the time it was offered, and I may change or withdraw a promotional reward at any time.
14. Privacy and Data Use
I collect and use client personal information to respond to inquiries, prepare quotes, make and service bookings, communicate about travel, process payments, provide requested services, and comply with applicable legal or supplier requirements.
Information may be shared with travel suppliers, airlines, cruise lines, hotels, tour operators, insurers, payment processors, technology providers, and other service providers when reasonably necessary to arrange, administer, process, or support your trip.
The separate Privacy Policy available on www.ahtravelsnyc.com explains how I collect, use, store, disclose, and protect personal information. By using my website or requesting services, you acknowledge that your information will be handled as described in the Privacy Policy.
15. Dispute Resolution and Governing Law
These Terms and Conditions are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Any dispute, claim, or legal proceeding arising out of or relating to these Terms and Conditions, the website, or services provided by AHTRAVELSNYC will be handled in the state or federal courts located in New York County, New York, to the extent permitted by applicable law.
Nothing in this section prevents a client from exercising a legal right that cannot be waived under applicable law.
16. Changes to These Terms
I may update these Terms and Conditions from time to time. The version posted on www.ahtravelsnyc.com applies from the date it is posted, unless a different effective date is stated.
You should review these terms periodically. Continued use of my website or continued use of services after updated terms are posted means that you accept the updated terms.
